1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Digivolt LLC ("Company," "we," "us," or "our"), concerning your access to and use of the Gamffy website (gamffy.com) as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Platform").

We are registered in New Mexico, United States and have our registered office at 1209 Mountain Rd Pl NE, Ste R, Albuquerque, NM 87110.

You agree that by accessing the Platform, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Platform Description

Gamffy is a digital marketplace platform that connects buyers and sellers of digital products, including but not limited to: in-game currencies, game accounts, gift cards, software licenses, subscriptions, and other digital goods. We act solely as an intermediary platform facilitating transactions between buyers and sellers.

Important: Gamffy does not own, create, or directly sell any of the digital products listed on our platform. All products are listed and sold by independent third-party sellers. We are not responsible for the quality, safety, legality, or any other aspect of the products listed by sellers.

3. Intellectual Property & Trademarks

All trademarks, service marks, trade names, logos, and brand names appearing on the Platform belong to their respective owners. Gamffy does not claim ownership of any third-party trademarks or intellectual property.

Product names, logos, brands, and other trademarks featured or referred to within the Platform are the property of their respective trademark holders. These trademark holders are not affiliated with Gamffy, our products, or our services. They do not sponsor or endorse our Platform or any of its content.

The use of any trademark on this Platform does not imply any affiliation with or endorsement by the trademark owner. All references to third-party products, services, or trademarks are for identification purposes only.

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Platform.

You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Buyer Terms

As a buyer on Gamffy, you agree to:

• Only purchase products for personal use unless otherwise specified
• Not use purchased products for any illegal or unauthorized purpose
• Accept that digital products are non-refundable once delivered, except as outlined in our Refund Policy
• Verify product details before completing a purchase
• Report any issues with orders within 24 hours of delivery
• Not attempt to defraud sellers or the Platform

6. Seller Terms

As a seller on Gamffy, you agree to:

• Only list products that you have the legal right to sell
• Provide accurate and complete descriptions of all products
• Deliver products within the specified timeframe
• Respond to buyer inquiries promptly
• Comply with all applicable laws and regulations
• Not engage in fraudulent or deceptive practices
• Accept responsibility for any disputes arising from your listings

Gamffy reserves the right to suspend or terminate seller accounts that violate these terms or receive excessive negative feedback.

7. Prohibited Activities

You may not access or use the Platform for any purpose other than that for which we make the Platform available. The Platform may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include but are not limited to:

• Systematically retrieving data or content to create a collection, compilation, database, or directory
• Circumventing, disabling, or interfering with security-related features of the Platform
• Engaging in unauthorized framing or linking to the Platform
• Tricking, defrauding, or misleading us and other users
• Using any information obtained from the Platform to harass, abuse, or harm another person
• Using the Platform to advertise or offer to sell goods and services outside the Platform
• Uploading or transmitting viruses, Trojan horses, or other malicious code
• Engaging in any automated use of the system
• Selling or transferring your account to another party

8. Third-Party Products Disclaimer

Gamffy is a marketplace platform only. We do not manufacture, store, or inspect any products sold on our Platform. All products are provided by independent third-party sellers.

We make no representations or warranties regarding:

• The legality of products in your jurisdiction
• The accuracy of product descriptions provided by sellers
• The quality or functionality of any product
• The validity or authenticity of game accounts, gift cards, or other digital items
• Compliance with third-party terms of service

Buyers are solely responsible for ensuring that their use of purchased products complies with all applicable laws and third-party terms of service.

9. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

10. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Platform; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights.

11. Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue formal dispute resolution.

For disputes between buyers and sellers, Gamffy may, at its sole discretion, mediate the dispute. Our decision in such mediation shall be final and binding on both parties.

12. Governing Law

These Terms shall be governed by and defined following the laws of the State of New Mexico, United States. Digivolt LLC and yourself irrevocably consent that the courts of New Mexico shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

13. Modifications

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change.

It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Platform after the date such revised Terms of Use are posted.
